This writ petition is filed for a writ of mandamus declaring the action of the respondent Nos.2 and 3 in not closing down the doors erected by the 4th respondent and in not removing the unauthorised construction of sump made in the petitioner premises, as illegal and arbitrary.
The case of the petitioner is that he is the owner and possessor of premises bearing No.6-1-102/G, 6-1-102/H, 6-1-102/I, situated at Padmarao Nagar, Secunderabad having purchased the same through the registered sale deed. While so, the 5th respondent has made unauthorised construction of the sump in the property claimed to be belonging to the petitioner. Against the same, petitioner made a representation on 25.09.2014 to respondent Nos.2 and 3, but no action has been initiated by the respondent authorities. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Smt. A.Deepthi, learned Standing Counsel for respondentCorporation submitted that in pursuance to the representation of the petitioner, respondents authorities have issued notice to the 5th respondent on 05.12.2014 and she has also produced a copy of the said notice before this Court.
In view of the submission made by the learned Standing Counsel for respondent-Corporation, it is open for the respondents to take further action.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
