THE HONOURABLE SRI JUSTICE P.KESHAVA RAO CRIMINAL PETITION No.3359 of 2018 ORDER:

Heard learned counsel for the petitioner/Accused No.6 as well as learned Special Public Prosecutor appearing for the respondents.

With the consent of both the counsel, the matter is being disposed of.

The present Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/Accused No.6 in CC No.88 of 2015. Charge sheet was filed by the ACB against him and other accused for the offences under Sections 8,12 and 14, 13 (1) (a) & (d) of PC Act read with Sections 109, 120(B), 34 IPC and under Section 13 (1) (a) & (d) read with 13 (2) of PC Act, 1988 and Section 120 (B), 34 IPC.

During the course of arguments, it is brought to the notice of this Court that the trial Court has already taken cognizance of the offences and registered the case as CC No.88 of 2015. In the said CC, notices were also issued.

In view of the fact that the trial Court has already taken cognizance of the matter and registered the case as CC, this Court is of the opinion that at this stage, the present criminal petition cannot be considered to quash the proceedings initiated against the petitioner. However, the petitioner is given liberty to approach

the trial Court and file an appropriate application seeking his discharge, if he is so advised, in which event, the trial court shall consider the same and pass appropriate orders as expeditiously as possible in accordance with law.

Accordingly, the criminal petition is disposed of. As a sequel there to miscellaneous applications, pending if any, shall stand closed. No costs.
