Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 2nd respondent in suspending the authorization of the petitioner vide order dated 13.02.2015, as arbitrary and illegal.
The petitioner is the dealer of fair price shop No.29, Gorukallu Village, Panyam Mandal, Kurnool District. On 05.01.2015, the 3rd respondent along with Mandal Revenue Inspector and Village Revenue Officer, inspected the fair price shop of the petitioner and found certain variations in the stocks. Based on the report submitted by the 3rd respondent, the 2nd respondent vide order dated 13.2.2015 suspended the authorization of the petitioner. Aggrieved thereby, the petitioner preferred an appeal along with stay application before the 1st respondent on 28.2.2015 and the same is pending.
Since the authorization of the petitioner was suspended on specific allegations, I am not inclined to
go into the merits of the case.
Under these circumstances, the 2nd respondent is directed to conduct enquiry and pass final order within a period of two months from the date of receipt of a copy of this order, notwithstanding the pendency of the appeal before the 1st respondent-Joint Collector, Kurnool.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
