HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44292 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.67 of 2016 on the file of Cyber Crime Police Station, Cyberabad. 2.

Heard and perused the material available on record. 3.

The above crime was registered for the offence under Sections 417, 419 and 420 IPC and Sections 66-C and 66-D of Information Technology Act, 2000 alleging that the petitioner and other accused formed ITBC company services and they are making telephone calls to the customers and in that process, they lured the 3rd respondent and collected total amount of Rs.33 lakhs and shared the said amounts proportionately. 4.

Taking into consideration the allegations made in the complaint, this Court is not inclined to interfere with the proceedings in the above crime. However, the petitioner is directed to surrender before the Court concerned and move an application for bail. On such application being filed, the Court concerned is directed to dispose of the same in accordance with law.
