This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.4 seeking to enlarge him on bail in connection with Crime No.50 of 2026 of Manuguru Police Station, Bhadradri-Kothagudem District. The offence alleged against the petitioner is punishable under Section 103 read with 3 (5) read with 49 of the BNS.

The case of the prosecution is that the de facto complainant lodged a report before police on 13.02.2026, wherein she stated that A.1 to A.4 murdered her son by
- 2 - pouring petrol and set fire on him, due to which the deceased succumbed to injuries. Prior to the incident, A.1 allegedly called the deceased to her house at Vagumallaram over phone keeping previous enmity, particularly on account of the deceased having extra-marital relationship with A.3, who is the younger sister of A.1, disputes had arisen between the parties and in that background the accused stated to have committed the murder of the deceased. Hence, she requested the police to take necessary action against the said complaint. Basing on the same, police registered a case for the aforesaid offence.

Heard Sri P.Rama Sharana Sharma, learned counsel for the petitioner/A.4 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioner/Accused No.4 is that the petitioner is innocent of the offence alleged against him; that from the reading of entire complaint, there are no allegations to attract the offence alleged against the petitioner, except stating that the petitioner is also there when the deceased went to the house
- 3 - of the other accused. He further submits that A.1 to A.3 were already arrested and they were released on bail and that the police also filed charge sheet in this crime and hence, he prays to grant regular bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioner is grievous and heinous in nature, as such the petitioner is not entitled for grant of bail and hence, he prays to dismiss the petition.

Considering the submissions made by learned counsel for both parties and upon perusal of the material on record, it is evident that the petitioner has been in judicial custody from 24.02.2026. According to the petitioner, entire investigation is completed and police also filed charge sheet. Copy of the bail order of A.1 to A.3 is also filed. Under these circumstances and taking into consideration the period of incarceration of petitioner in jail, this Court deems it fit to grant bail to the petitioner/A.4 subject to the following conditions:
(i) The petitioner-accused No.4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a
- 4 - like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Manuguru. (ii) On such release, the petitioner-accused No.4 shall appear before the concerned SHO between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioner-accused No.4 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
