ORDER:

This writ petition is filed for a Mandamus to declare the action of the respondents in issuing Notification Rc.No.C2/321/2012, dated 12.1.2012, reserving Fair Price Shop No.13016 of Annarugudem Village in favour of Scheduled Tribe candidates, as illegal and arbitrary.

At the hearing, learned counsel for the petitioner is not present. Learned Government Pleader for Civil Supplies (TS) on instructions submitted that during the pendency of the writ petition the respondents have not proceeded with filling up the vacancy as per the impugned Notification and that the vacancy was filled up by appointing one Mr. Suda Raghu, son of the deceased permanent dealer under compassionate appointment scheme under G.O.

Ms.

No.4, dt.28.2.2014, providing for compassionate appointment. In view of this submission, which remained uncontroverted, the writ petition is dismissed as infructuous.

As a sequel to dismissal of the writ petition, W.P.M.P. No.4417 of 2012 shall stand disposed of as infructuous.
