THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3326 OF 2018 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to release the petitioners on bail in the event of his arrest in connection with Crime No.26 of 2017 of Ananthapur rural police station, Ananthapur District registered for the offence punishable under Sections 419, 420, 468 & 471 read with 34 of the Indian Penal Code, 1860 (for short 'IPC'). The main allegation against the petitioners is that they have created false voter identity cards and other documents impersonating the father of the de facto complainant and sold the property and on the strength of the same the police registered the crime and issued First Information Report.

The counsel for the petitioners requested this Court to issue a direction to the concerned Magistrate having jurisdiction to grant bail to the petitioners on their surrender.

Without going into the merits of the case, the petitioners are permitted to surrender before the concerned Magistrate, on such surrender and on filing an application under Sections 437 and 439 CrPC, concerned Magistrate is directed to decide the same on the same day, in accordance with law.
