THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO SUO MOTU C.C.No.2072 of 2017 ORDER:

This Suo Motu Contempt Case is issued proposing to take action against the respondents in W.P.No.23405 of 2008 on the ground that in spite of the fact that the said Writ Petition was allowed on 22-06-2016 quashing the order dt.09-09-2008, the Tahsildar, Satyavedu, had issued show cause notice dt.15-09-2016. This aspect has been dealt with by me in detail in the order pronounced by me today separately in Rev.W.P.M.P.No.10721 of 2017 in W.P.No.23405 of 2008 wherein this Court while allowing the review, set aside that portion of the order which permitted the 4th respondent to take any action by issuing another show cause notice to the petitioner. Once that portion of the order dt.22-06-2016 in W.P.No.23405 of 2008 has been set aside, automatically, the notice dt.

15-09-2016 falls to the ground and no action can be taken by the Tahsildar, Satyavedu, on the basis of the order dt.22-06-2016 in W.P.No.23405 of 2008 by issuing the fresh notice dt.15-09-2016. In that view of the matter, I see no reason to take any further action against 4th respondent and the matter is closed. No costs. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
