HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.19267 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and Sri Bathula Raj Kiran, learned Standing Counsel appearing for respondents 1 to 4. This writ petition is filed seeking to declare the action of the respondents in not appointing the petitioner as Sub-Staff in pursuance of the orders of the Apex Court in Civil Appeal No.953-968 of 2005, as arbitrary and illegal.

The petitioner joined in the respondent-Life Insurance Corporation of India, Nellore Division of Giddalur Branch, as Sub-Staff on 1.4.2004, on temporary basis. On an identical issue, similarly situated persons approached the Apex Court by filing Civil Appeal No.953-968 of 2005, wherein the Apex Court directed the respondent-Corporation to conduct one time limited written examination for those temporary persons, who are working in LIC for more than five years and who had possessed minimum eligible qualification and age as prescribed at the relevant time of their entry into service and consider them for regularization and

that the examination shall be in vernacular language with a limited syllabus which will be announced in advance.

Though the petitioner possesses the eligibility criteria, it appears that the respondent-Corporation dis-engaged his services in 1.11.2011.

The petitioner made a representation dated 31.1.2015 to the respondent-Corporation and the same is pending. Hence, the petitioner filed the present writ petition to consider his case in terms of the judgment of the Apex Court.

Under these circumstances, the Writ Petition is disposed of directing the respondents to consider the representation dated 31.1.2015 submitted by the petitioner and take appropriate action in terms of the judgment of the Apex Court in Civil Appeal No.953-968 of 2005 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
