THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2266 OF 2015 ORDER:
This criminal revision case under Sections 397 and 401 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking to set aside the docket order, dated 29.07.2015 passed in C.C.No.464 of 2015 on the file of the Court of the Judicial First Class Magistrate, Kodad, whereby the learned Judge issued Non Bailable Warrant (NBW) against the petitioner/A.1. Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner/A.1 is now in United States of America (USA) and he wants to come to India and is apprehending arrest in view of the NBW pending against him. He further submits that the petitioner is a law abiding citizen and he is ready to face the trial and as such, prays this Court to recall the NBW issued against the petitioner/A.1. In view of the facts and circumstances, in the event of arrest of the petitioner/A.1 herein, the Court below is directed to release the petitioner on bail on the same day on execution of a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the likesum to the satisfaction of the said Magistrate. It is also made clear that if the petitioner is not arrested by the police, the petitioner/A.
1 is directed to appear before the Court below and file an application for recalling NBW issued against him within a period of one week from date of his arrival, and on filing of such application, the Court below is directed to recall the NBW issued against the petitioner/A.1 on the same day on his executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the likesum to the satisfaction of the said Magistrate for future appearance. The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
