THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.21827, 24080 AND 27932 OF 2016 AND CONTEMPT CASE No.2050 OF 2017 COMMON ORDER:

These cases are being disposed of by this common order as they arise out of the same cause of action.

These three writ petitions were filed challenging the action of the respondents 4 and 5 in not increasing the petitioners' fitment/scale of pay by four increments on par with juniors fitment/scale of pay, as per the chart No.3 for category IV: Assistant Managers, proposed to be increased in violation of the terms of Memorandum of the Agreement, dated 22.04.2016, under Section 18(1) of the Industrial Disputes Act arrived at between the respondents 2 and 3, even after submitting the representation on 27.06.2016.

There was no interim order in W.P.Nos.21827 and 27932 of 2016. An interim order, dated 21.07.2016, was passed in W.P.M.P.No.29663 of 2016 in W.P.No.24080 of 2016. The contempt case No.2050 of 2017 was filed alleging violation of the said interim order. Now in the contempt case, the respondents filed a counter affidavit stating that pursuant to the interim order, dated 17.11.2017, passed in C.C.No.2050 of 2017, the matter was examined and a communication was issued on 28.03.2018 stating as follows.

"Since the Settlement is made under 18(1) of ID Act by mutual discussions and Agreement between the Andhra Pradesh Cooperative Banks' Association and Andhra Pradesh Cooperative Central Banks Employees'

Association representing the Workmen/Officers and implemented, no further action is considered necessary on the copy of the letter, dated 10.04.2017, said to have been addressed by the District Cooperative Central Bank Limited, Kakinada, East Godavari regarding the representation dated 27.06.2016 of the employees".

In view of the same, the writ petitions and the contempt case are closed giving liberty to the petitioners to take appropriate proceedings in accordance with law pursuant to the communication issued on 28.03.2018.

Consequently, miscellaneous petitions, if any pending, in the writ petitions shall stand closed.
