THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41681 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent No.4 in issuing notices, dated 5.11.2015, to the petitioners demanding them to pay the crop loans as illegal, arbitrary and against the principles of natural justice and consequently, direct respondent No.4 not to demand the petitioners to pay any crop loans.

Heard and perused the material available on record. 3.

Considering the facts and circumstances of the case and the grievance of the petitioners, this writ petition is disposed of with the following direction:

The petitioners are directed to obtain a certificate from the competent authority to substantiate the fact that they were already allotted the lands in question and they shall make a representation to respondent No.4 along with the said certificate seeking waiver of the crops loans on the ground that they are holding the lands in question as per the allotment made to them by the competent authority and on such representation being made, respondent No.4 shall consider the same and pass appropriate orders in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
