THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23097 OF 2017 ORDER:
This writ petition is filed seeking to issue a writ of mandamus to declare the action of the respondents in not laying an underground sewerage pipeline for the smooth flow of the sewerage water of the Kistapur Village, as illegal and arbitrary and consequently, direct the respondents to lay appropriate underground sewerage pipeline. Heard and perused the material available on record. The petitioner is an Association of Schedule Caste residents of Medchal Mandal, Kistapur village, hamlet of Medchal Village. Most of the members of the petitioner are residing in the weaker section colony. The grievance of the petitioner is that the sewerage water belonging to the Kistapur village, which is accumulated on the other side of MedchalShameerpet road, is diverted to their side and running into the lands and the houses. Therefore, the petitioner made representations, dated 25.02.2017, 27.03.2017 and 27.01.2017 to the respondents to lay underground pipeline for the sewerage water of the village. But, no action has been taken by the respondents so far. Hence, this writ petition.
Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is of the view that the writ petition can be disposed of with a direction to the respondents 2 and 3 to pass appropriate orders on the representations made by the petitioner.
Accordingly, the Writ Petition is disposed of directing the respondents 2 and 3 to consider representations, dated 25.02.2017, 27.03.2017 and 27.01.2017 made by the petitioner, and pass appropriate orders in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.
No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
