THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40070 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for the records in connection with FIR No.789 of 2016 and to quash the same.
The allegations made in the present complaint lodged by the 4th respondent against the petitioner are that on 31.08.2016 in between 10.30 hours to 14.00 hours while the General Body meeting was going on at Tattiannaram Ward Office in the presence of Manchireddy Kishan Reddy, MLA, the petitioner and Jorka Jagan were arguing with one G. Anupama, the counsellor of the 4th ward, on that the 4th respondent tried to stop them, but the petitioner and Jorka Jagan abused him in most filthy language by using his caste name and basing on the said complaint, the 3rd respondent registered a case as Crime No.789 of 2016 for the offence punishable under Section 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against the petitioner and Jorka Jagan.
The main grievance of the petitioner is that the 3rd respondent is frequently calling the petitioner over phone to the police station and threatening the petitioner that he will arrest the petitioner and produce before the concerned Court. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.789 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. In case, if any charge sheet is filed and summons are received by the petitioner, he shall appear before the Court concerned and execute a personal bond for a sum of Rs.
satisfaction of the concerned Court for his future appearance before the concerned Court.
