Vanam Sammaiah, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.8853 of 2018 ORDER:
This writ petition is filed declaring the action of the respondents in not providing police aid as directed in the orders dated 31.08.2017 of the learned Principal Junior Civil Judge, Parkal in I.A.No.18 of 2017 in I.A.No.268 of 2015 in O.S.No.83 of 2015 as illegal, arbitrary, highhanded and contrary to the principles of natural justice. 2.
I have heard the submissions of the learned counsel for the petitioner and the learned Government Pleader for Home (TG) appearing for the respondents. I have perused the material record. 3.
Learned counsel for the petitioner, while reiterating the case pleaded in the writ petition, would submit that the petitioner filed an additional affidavit before this Court stating that the order granting temporary injunction, which was passed on 08.12.2016 in I.A.No.268 of 2015 in O.S.No.83 of 2015 on the file of the Principal Junior Civil Judge, Parkal, has become final and that no appeal or revision has been filed against the said order by the opposite parties and that the order granting police aid, which was passed on 31.08.2017 in I.A.No.18 of 2017 in I.A.No.268 of 2015 in O.S.No.83 of 2015, has also become final. He would further submit that despite orders of the trial Court granting police aid for implementation of the temporary injunction orders, police are not giving necessary police protection and, therefore, the petitioner is being harassed by the defendants in the said suit and
there is an apprehension of dispossession of the petitioner from the property covered by the afore-stated suit.
4.
Learned Government Pleader for Home (TG), on oral instructions, would submit that the police are prepared to extend police aid for implementation of the temporary injunction orders of the civil court on the petitioner approaching them with an appropriate representation by enclosing the copies of the necessary orders of the civil court. 5.
Recording the submissions, the Writ Petition is disposed of reserving liberty to the petitioner to file a representation before the respondents along with copies of the orders of the civil court for implementation of the temporary injunction orders of the civil court, as directed in the orders dated 31.08.2017 in I.A.No.18 of 2017 in I.A.No.268 of 2015 in O.S.No.83 of 2015 on the file of the Principal Junior Civil Judge at Parkal.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
