HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.702 of 2014 ORDER :

This petition is filed to withdraw O.S.No.23 of 2008 from the file of III Additional District and Sessions Judgecum-Fast Track Court, Bhimavaram, to any other Court in West Godavari District, in the interests of justice.

2. Petitioners are defendants in the above referred suit and according to their affidavit, the Presiding Officer is liberally granting adjournments in spite of petitioners reporting ready and requesting the Court to take up the case.

3. Heard arguments.

4. Learned counsel for petitioners submitted that in spite of personally making a request, the Court is not taking up the matter and adjourning the case at the fag end of the day without any progress. It is submitted that in the above referred suit issues are framed and now it is at the stage of commencement of trial.

5. Learned counsel for respondent submitted that since the allegation is that the Court is granting liberal adjournments, some time may be fixed for disposal of the case by directing the Court below so that transfer C.M.P. can be disposed of.

6. Considering the submissions of both sides and also considering the reasons that are stated in the affidavit

seeking transfer, I feel that the transfer C.M.P. can be disposed of directing the Court below to take up O.S.No.23 of 2008 on day-to-day basis and dispose of it, as expeditiously as possible, preferably within three months from the date of receipt of this order. Both parties shall cooperate with the Court in disposing of the case.

7. Accordingly, transfer C.M.P. is disposed of. No costs.

8. Miscellaneous Petitions, if any, shall stand closed. __________________ S. RAVI KUMAR, J 10th March 2015.
