HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 6199 of 2015
ORDER
This Criminal Petition under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A1 seeking anticipatory bail to him in connection with Cr.No.351 of 2015 of Jubilee Hills Police Station, Hyderabad District, registered for the offences under Sections 498-A, 323, 506 read with Section 34 IPC and under Sections 3 and 4 of Dowry Prohibition Act.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State.
3. It is alleged that the marriage of petitioner/A1 with the de facto complainant, by name Sailaja, was performed on 29.01.2015 and they were living together. It is alleged that the petitioner/A1 is suspecting the character of the de facto complainant and on that ground, he used to harass his wife and treated her as servant by abusing bad words. It is also alleged that when the de facto complainant conceived three months pregnancy, the petitioner/A1 forced her to get aborted on the ground that the child conceived by her is not his and also used to harass her to give her salary to him.
4. Learned counsel for the petitioner submitted that all the allegations are very vague and that there is every possibility of matter being reconciled and if the petitioner is arrested, it may aggravate the situation and also it is difficult to the parties to reconcile their differences.
5. Taking into consideration the fact that the petitioner/A1 is a permanent resident of Hyderabad and is working as Software Engineer and so also the de facto complainant, I deem it appropriate to dispose of the criminal petition with the following directions;
The petitioner/A1 is directed to surrender before the learned XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad and move an application for bail. On filing such an application, the learned Magistrate shall dispose of the same on the same day subject to certain reasonable conditions as it deem fit by the learned Magistrate.
