HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.3946 of 2015 in Crl.P.No.3665 of 2015 and Criminal Petition No.3665 of 2015 COMMON ORDER:

T h e defacto complainant and his counsel Sri Sk.Rizwan Ali are present. A.2 and Routhu Suresh Naidu (proposed accused) and their Counsel Sri N.Ravi Prasad are present.

On the report given by defacto complainant the police of Rajahmundry III Town PS, East Godavari registered a case in Cr.No.87 of 2015 against the accused for the offences under Sections 323, 324, 506 and 34 IPC and Sections 3(1)(x) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 and investigation is stated to be pending. Be that it may, the parties and their counsel present in Court today and submitted that at the intervention of elders the defacto complainant had already compromised and compounded the offence sofaras A1 is concerned in Crl.M.P.No.2959 of 2015 and now at the intervention of elders defacto complainant wants to compromise the issue with the other accused also and therefore, Court may be pleased to permit the parties to compound the offence and quash the proceedings in the interest of justice.

Having regard to the above submission and in view of the fact that the parties are known to each other and they want to settle the disputes between them and no useful purpose will be served even if the investigation is ordered to be continued since the parties have amicably resolved their disputes and following the decision reported i n Gian Singh vs. State of Punjab and another, this petition is allowed and permission is accorded to the parties to compromise the matter and consequently proceedings in FIR No.87 of 2015 of Rajahmundry III Town PS, East Godavari District are hereby quashed against A2 and Routhu Suresh Naidu (proposed accused) as per the

compromise petition filed by the parties.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
