HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.15932 OF 2016 ORDR:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'the Code'), is filed by the petitioner - accused seeking to quash the proceedings in P.R.C. No.2 of 2015 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad, registered for the offence punishable under Section 3 (1) (x) of the Scheduled Castes and the Schedule Tribes (Prevention of Atrocities) Act, 1989.

2. A joint memo (S.R. No.1681 of 2017) is filed by both parties stating that the matter has been settled between them outside the Court.

3. Both parties as well as their learned counsel are present and the parties are identified by their respective learned counsel, Sri Sharad Sanghi and Sri P. Amarender Reddy. The parties have also produced photostat copies of their respective "Aadhaar Cards" in proof of their identity.

4. On being enquired, both parties would represent that they resolved all their disputes at the intervention of elders and they wanted to live peacefully.

5. Since both parties have entered into compromise and affirmed the contents of joint memo filed by them, compromise is

recorded as the dispute falls within the guidelines laid down by the Hon'ble Supreme Court in Gian Singh v. State of Punjab1.

6. Hence, the present Criminal Petition is allowed quashing the proceedings against the petitioner - accused in P.R.C. No.2 of 2015 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad. The aforesaid joint memo filed by both the parties shall form part of the record.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
