HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 28509 OF 2011 ORDER:
The present Writ Petition came to be filed seeking to declare the inaction of respondent No.4 herein in disposing the appeal filed by the mother of the petitioner herein i.e., Smt.Kondru Rajeswari @ Parvathi, against order dated 28.03.2011, passed in proceedings Rc.No.48/2001/A, by Tahsildar (respondent No.5), Anandapuram, as illegal and arbitrary and consequently direct respondent No.4 herein to dispose of the said appeal forthwith, in accordance with law. Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
Though various issues are raised by the learned counsel for petitioner in the Writ Petition, he however restricts his prayer seeking a direction to respondent No.4 herein to dispose of the appeal filed by the mother of the Writ Petitioner by name Smt.Kondru Rajeswari @ Parvathi, against the order dated 28.03.2011, passed by respondent No.5, at the earliest. He further submits that though the appeal was filed in the year 2011, the same is still pending.
Having regard to the facts and circumstances of the case, respondent No.4 herein (the Joint Collector, Visakhapatnam) is hereby directed to dispose of the appeal filed by the mother of the writ petitioner, against the order dated 28.03.2011, passed in proceeding Rc.No.48/2001/A, within a period of eight (08) weeks from the date of receipt of a copy of this order, if the same is still pending before him. Accordingly, the Writ Petition is disposed of. No costs.
Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
