Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the first and second respondents in not considering and disposing of the claim/representation dated 16.04.2012, for grant of pattadar pass book and title deed in accordance with the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Book Act, 1971 as illegal and arbitrary and consequently direct the respondents to consider and dispose of the representation dated 16.04.2012 and to grant pattadar pass book and title deeds in respect of the lands admeasuring Ac.0.45 cents, Ac.0.32 cents, out of Ac.1.54 cents in Survey No.623/ID of Tirupathi Village.

The facts in issue are as under:

The petitioner detailed about the land dispute with regard to the lands purchased and acquired by him admeasuring Ac0.45 cents, Ac.0.32 cents, out of Ac.1.54 cents in Survey No.623/ID of Tirupathi Village. It is stated that the petitioner approached the revenue authorities for grant of pattadar pass book and title deeds and also for mutation of his name in revenue records. As there was no response from the respondents, several reminders were sent to the first and third respondents and also filed a petition before the first respondent seeking settlement of disputes.

As there was no

response from the respondents, the petitioner made an application dated 16.04.2012, requesting the authorities to issue pattadar pass book and title deed by enclosing the sale deed. It is also stated that the name of the petitioner was registered in revenue records in terms of Board Standing Orders. It is the case of the petitioner that he approached the respondents several times to consider his representation dated 16.04.2012, but in vain. Aggrieved thereby, the present Writ Petition came to be filed.

Learned Government Pleader for Revenue did not dispute about the pendency of representation dated 16.04.2012. Having regard to the circumstances stated above, the Writ Petition is disposed of directing the third respondent to dispose of the representation dated 16.04.2012 made by the petitioner for issuance of pattadar pass books and title deeds in respect of his land admeasuring Ac0.45 cents, Ac.0.32 cents, out of Ac.1.54 cents in Survey No.623/ID of Tirupathi Village, in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. It is needless to mention that the petitioner is at liberty to place relevant material before the authorities, along with a copy of this order. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
