THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10949 of 2016 ORDER:

Heard Sri K. Srinivas, learned counsel for the petitioner, and Sri G. Narsimha, learned counsel representing Sri Ancha Panduranga Rao, learned Standing Counsel for the 2nd respondent - Guntur Municipal Corporation.

The prayer of the petitioner in this case is as under: "That this Hon'ble Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declare the action of the 2nd respondent in not disposing the petitioner application dated 17.03.2016 for extension of lease period of maintenance of toilets inside and outside at PVK Naidu Market Toilets, Guntur City, Guntur District, consequently direct the respondent no.2 to dispose the application dated 17.03.2016 for extension of lease period of maintenance of toilets inside and outside at PVK Naidu Market toilets, Guntur City, Guntur District, forthwith, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sri G. Narsimha, learned counsel, informed this Court that the petitioner's application dated 17.03.2016 is still pending consideration before the municipal authorities. That being so, this Court sees no reason to entertain this writ petition for adjudication on merits as the authorities concerned are yet to take a decision upon the petitioner's application dated 17.03.2016.

The writ petition is accordingly disposed of directing the municipal authorities to consider and dispose of the petitioner's application dated 17.03.2016, whereby he sought extension of the lease in relation to maintenance of subject toilets in accordance with law and pass appropriate orders thereon. This exercise shall be completed as expeditiously as possible and in any event, not later than two weeks from the date of receipt of a copy of this order.
