HONOURABLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.16855 of 2017 ORDER:

This Writ Petition is filed to declare the inaction of the respondents 1 to 3 in considering the case of the petitioners to allot, lease out the land to run tiffen center to an extent of 100 sq.yards situated in Sy.No.201 at Mini Shopping Complex of Vanastalipuram Residential Shopping complex, Phase-I, Saheb Nagar Kalyam Village, Hayathnagar Revenue Mandal, Ranga Reddy District, L.B. circle No.II of Grater Hyderabad Municipal Corporation Limits, as illegal and arbitrary. Heard and perused the material available on record. The petitioners 1 and 2 are in possession of the open site of an extent of 154 square yards for the last 25 years and eking out their livelihood by running a vulcanizing shop and a mechanic shop in the said site.

While so, the petitioners made representations to the respondents 1 to 3 with a request to lease out the said site in their favour, but the respondents leased out 54 square yards of land only out of 154 square yeards, in favour of the 2nd petitioner. The contention of the 1st petitioner is that he made an application, dated 03.05.2017, for granting lease of the remaining 100 square yards of land in his favour, but the same was not considered and it is pending. Learned counsel for the petitioners requested this Court to direct the respondents 1 to 3 to consider the application of the 1st petitioner and pass appropriate orders. Learned Standing Counsel for the respondents 2 and 3 also did not object for the same.

In view of the submissions of both counsel, I deem it appropriate to direct the respondents 2 and 3 to consider the representation of the 1st petitioner and pass appropriate orders in accordance with law as expeditiously as possible.

Accordingly, the Writ Petition is disposed of directing the respondents 1 to 3 to dispose of the representation, dated 03.05.2017, submitted by the 1st petitioner and pass appropriate orders in accordance with law within a period of one month from the date of receipt of a copy of this order, and communicate the same to the petitioners.

No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
