THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13984 of 2016 ORDER:
1) The petitioner, who is accused No.20 preferred the present Criminal Petition under Section 440 (2) of the Code of the Criminal Procedure (Cr.P.C.), seeking relaxation of the condition imposed in order dated 31.08.2016 in Crl.M.P.No.436 of 2016 on the file of the Sessions Judge, Krishna, Machilipatnam, in connection with Crime No.70 of 2013 of Jaggaiahpeta Police Station, now under CID, Vijayawada.
2) Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. 3) By an order dated 31.08.2016, the petitioner was granted bail by the learned Sessions Judge on condition of his executing bond for a sum of Rs.5,00,000/ - with two sureties for the likesum each to the satisfaction of Sessions Court, apart from imposing certain other conditions. Aggrieved by the said order, to the extent of directing the petitioners to furnish two sureties for a sum of Rs.5,00,000/ - each, the present petition is filed. 4) Having regard to the facts and circumstances of the case and in view of the earlier order passed, the petitioner is directed to furnish two sureties for a sum of Rs.50,000/ - (Rupees Fifty Thousand only) each. Further, out of two sureties, one surety must be a local surety. It is made clear that the impugned order is
modified only to the extent indicated above and the other conditions stipulated in the impugned order remain unaltered. 5) Accordingly, the Criminal Petition is disposed of.
Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
