THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.32148 OF 2013 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents 1 to 3.
The prayer sought for in the writ petition is as under: " to issue an appropriate Writ Order or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents 1 to 3 and 5 herein in insisting the petitioner to withdraw the complaint dated 30-03-2013 which was acknowledged under receipt No.78 by the 3rd respondent is arbitrary, illegal, capricious and colourful exercise of their powers to safeguard the respondents 4 and 5 and consequently direct the respondents not to harass the petitioner in respect of matrimonial disputes with the 4th respondent." During the course of hearing, the learned Government Pleader placed on record the written instructions dated 06.03.2014 issued by the Sub-Inspector of Police, Nandikotkur Police Station, Kurnool District.
A perusal of the said written instructions would reveal that the Station House Officer did not initiate any action except orally advising the petitioner to settle the disputes in a competent Court since it is purely a family dispute and also civil in nature. The said instructions are placed on record. In view of the above, this Court is of the opinion that no further orders are required in the writ petition and the same is accordingly dismissed. No costs.
