THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.37452 OF 2012 ORDER: (per SK,J) Sri Krishna Devan, learned counsel for the petitioner, would submit that though this writ petition was filed aggrieved by the order dated 31.10.2012 passed by the Central Administrative Tribunal, Hyderabad Bench, Hyderabad, in O.A.No.846 of 2011, in relation to the order dated 27.07.2011 passed by the Chief General Manager, Telecom, A.P. Circle, BSNL, Hyderabad, the first respondent herein, the subsequent order dated 06.02.

2014 passed by the General Manager, Telecom, BSNL, Rajahmundry, East Godavari District, the second respondent herein, would give rise to a fresh cause of action and as this Court has given liberty to the petitioner by a separate order passed in the amendment petition filed in this writ petition to avail statutory remedy as per the law laid down by the Constitution Bench of Seven Judges in L.Chandra Kumar v. Union of I ndia1, the writ petition may be disposed of so that the petitioner may seek redressal of his grievance in relation to the later order dated 06.02.2014 by way of the statutory remedy.

The writ petition is accordingly closed. As the petitioner had the benefit of the protection of the interim orders granted during the pendency of this writ petition, the same shall continue for a period of four weeks from the date of receipt of a copy of this order. In the meanwhile, it shall be open to the petitioner to invoke the statutory remedy available to him and seek suitable interim protection therein. 1 (1997) 3 SCC 261

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
