THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7736 OF 2016 ORDER:

This petition is filed by the petitioners-A1 to A3 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.184 of 2016 on the file of II-Town Police Station, Ananthapuramu, for the offences punishable under Sections 323 and 506 IPC and 3(1)(x) of SCs & STs (POA) Act, 1989.

The case of the prosecution is that while the petitioners and one Harish Kumar were quarrelling and abusing each other, the de facto complainant intervened and stopped them and with the help of other villagers, he took the injured Harish Kumar to the Hospital, where the petitioners abused the de facto complainant in the name of his caste and pushed him down.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and due to political rivalry, they were implicated in the present case with false allegations.

The learned Additional Public Prosecutor submitted that in view of bar under the provisions of the SC & ST Act, this petition is not maintainable.

Considering the facts and circumstances of the case and in view of the submissions made by the learned Additional Public Prosecutor, this Court is of the view that this petition is not maintainable.

Accordingly, the Criminal petition is dismissed. ______________ RAJA ELANGO, J June 14, 2016.
