THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.19642 of 2017 ORDER :

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:

" to pass and order, or orders, direction or directions, or issue a writ, more particularly in the nature of Writ of Mandamus, Declaring the action of respondents in trying to dispossess the petitioner from the agricultural land to the total extent of 12 acres situated in Sy.No.63 of Kanpa Mediguda village, Mandal Jainath, District Adilabad, without due process of law is illegal, arbitrary, violative of Article 14 & 21 of the Constitution of India, and further direct the respondents to continue the agricultural activities of the petitioner in the above said land, and to pass any such other order orders as this Hon'ble Court may deemed fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and learned Government Pleaders for Irrigation and Revenue for the respondents and perused the prayer in the writ petition with supporting affidavit and other material on record including the proceedings dated 20.03.1995 of the Mandal Revenue Officer, Jainath, referring to the report of the V.A.O/ M.R.I. of Kanpamediguda Village, about the petitioner that he is cultivating the land of Ac.12.00 cents in Survey No.63 without any right. Having regard to the above, the Writ Petition is disposed of at the stage of admission, directing the respondents not to evict the petitioner except through due process of law, even if it is a settled encroachment. No costs.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
