THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25818 of 2003 ORDER:

This writ petition is filed seeking the following relief: " to issue a writ , order or directions, more in the nature of writ of Mandamus declare the Officer Order No.PA/ 581(2)/ 2001-DVM-NZB dated 11.9.2001 and proceedings No.Peshi/ 675(38)/ 2003-RM-NZB dated 25.9.2003 passed by the 3rd and 2nd respondents herein as illegal and arbitrary and set aside the same with a consequential directions to the 3rd respondent to restore the punishment and pay arrears and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

When the matter is taken up for hearing, it is reported by the learned counsel for the petitioner that the petitioner retired from service. Learned counsel for the petitioner further submitted that the challenge in the writ petition is with regard to imposition of punishment of stoppage of two annual grade increments without cumulative effect and since the said punishment was over, the increments which were stopped will automatically get back to the petitioner and, therefore, the cause in the writ petition does not survive.

Accordingly, the Writ Petition is dismissed. No order as to costs.
