HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 25038 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents transferring the petitioner vide Inter Office Note dated 30.10.2003 from Group Centre to 38 BN Eastern Sector, as illegal and arbitrary. A consequential direction is also sought to continue the petitioner till retirement as the petitioner's application for voluntary retirement is under active consideration. When the matter is taken up for hearing, it is submitted by the counsel for the respondents that while admitting the writ petition, this Court granted interim stay of the impugned Inter Office Note, vide orders dated 28.11.2003 in WPMP No.31546 of 2003 and, subsequently, the said interim order was vacated vide orders dated 21.04.2004 passed in WVMP No.751 of 2004. It is also brought to the notice of the Court that the petitioner is not working in the Office of the Addl. DIGP. Group Center, CRPF, JJ Nagar Post, Ranga Reddy District.

In view of the submission made by the learned counsel for the respondents, the cause in the writ petition does not survive and, accordingly, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
