Heard learned counsel for the petitioner and learned Standing Counsel for the Bank appearing for respondent No.1.
The limited submission of the petitioner is that he is neither the principal borrower nor a guarantor to one Kallam Peri Reddy. The petitioner claims to be a tenant in premises bearing No.12-13-32, Kuglar Hospital Road, opposite to Dr. A. Kavitha Hospital, Kothapeta, Guntur.
It is contended that the petitioner cannot be denied entry and exit into his premises by the 1st respondent. Alternatively, it is contended that the petitioner is not very keen to continue his practice from Door No.12-13-32 and he is ready to vacate the premises provided the seizure is lifted by the 1st respondent and the petitioner is permitted to remove and take away all his belongings, equipment etc., from the premises.
Learned Standing Counsel submits that as the grievance is narrowed down to permit the petitioner to remove and take away the belongings etc., the petitioner can make a representation to the 1st respondent and the 1st respondent would certainly consider the same without lapse of time and permit the petitioner to remove and take away his belongings from the premises. The petitioner is given liberty to make a representation to the 1st respondent on the lines stated above and the 1st respondent, after receiving the representation, within two days thereafter, takes appropriate decision facilitating removal of the belongings of the petitioner from the premises. With the above observation, the Writ Petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
