THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.519 OF 2017 O R D E R :

Petitioner has filed this Contempt Case alleging violation by the 1st respondent and others of the order dt.21.10.2014 in WP.MP.No.39512 of 2014 in W.P.No.31608 of 2014. 2.

In the said order, this Court had suspended the order dt.16.08.2014 of the Warangal Municipal Corporation and directed its officials not to interfere with the construction of the building being made by the petitioner in the land claimed by him pursuant a building permission dt.24.06.2014 granted to him by it. 3.

Petitioner alleges that respondents 2 and 3 in the Contempt Case in collusion with a Member of the Legislative Assembly have conducted a religious ceremony in the subject land, in which the officials of the Warangal Municipal Corporation were present and thus the interim order has been violated.

It is not the case of the petitioner that any employee of the Warangal Municipal Corporation including the 1st respondent has conducted the religious ceremony in the land claimed by the petitioner. As regards respondents 2 and 3, they are not parties in the Writ Petition nor is the MLA, who is alleged to be supporting them, and who is alleged to have conducted the religious ceremony in the land claimed by the petitioner.

Therefore, in the facts and circumstances of the case, none of the respondents can be punished for Contempt of Court.

Accordingly, this Contempt Case is dismissed. No costs. 7.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
