HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18894 OF 2016 ORDER:

The case of the petitioner is that she is the absolute owner in possession and enjoyment of the land admeasuring Ac.4.29 guntas in Survey No.144/10, situated at Pinapakapatti Nagar, Burghampahad Mandal, Khammam District and the petitioner was also issued pattadar Pass Book and title deeds. While so, the 5th respondent with an intention to occupy petitioner's land, has approached the office of the 4th respondent and requested for change of records.

Thereafter, the petitioner submitted representation dated 26.03.2016 to the respondents and also filed WP.No.10806 of 2016 seeking direction to the respondents to consider her objection before affecting any change in the revenue records and the said writ petition was admitted and pending. After admission of the said writ petition the 4th respondent obtained the petitioner's statement on 16.04.2016 and entered the name of the 5th respondent in the manual pahani for the years 2014-2015 and 2015-2016, without issuing any notice to the petitioner. When the petitioner obtained certified copy of the statement dated 16.04.2016, it shows as if the petitioner alienated the property in favour of the 5th respondent. As such, she submitted representation dated 22.04.2016, before the 4th respondent stating that she never alienated the property at any point of time. Aggrieved by the action of the 4th respondent in incorporating the name of the 5th respondent in the manual pahanies, without issuing any notice and without following due procedure, the petitioner filed the present writ petition.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since it is stated that the representation of the petitioner dated 22.04.2016 is stated to be pending before the 4th respondent, the 4th respondent is directed to consider the said representation and dispose of the same within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing notice to the affected parties as per Section 5(3) of the A.P.Rights in Land and Pattadar Pass books Act, 1971, and take action accordingly.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
