THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.24803 of 2014 Oral Order:

The petitioner complains against the inaction of the respondents in disposing of petitioner's representation dated 27.5.2014 as illegal and unconstitutional.

Learned counsel appearing for the petitioner submits that essential commodities are distributed through Fair Price Shop No.27 of Ulimeswaram Village of Peddapuram Mandal, East Godavari District by the father-in-law of the 5th respondent but not by the 5th respondent personally.

Learned Government Pleader for Civil Supplies however, submits that in distribution of the essential commodities taking assistance of the one of the family member is permitted and that unless and until serious allegations are pointed out no action can be initiated.

In the circumstances, the writ petition is dismissed by giving liberty to the petitioner to make fresh representation if the 5th respondent commits serious lapses in distribution of the essential commodities through Fair Price Shop No.27 of

Ulimeswaram Village, Peddapuram Mandal, East Godavari District.

Accordingly, the writ petition dismissed. No costs. Miscellaneous Petitions if any pending shall stand closed.
