The present appeal suit is filed by the appellant aggrieved by the judgment and decree dated .lZ.O7.2OOZ passed in O.S. No 170 of 2003 on the file of the learned V Additional District Judge, Ranga Reddy.

Heard Ms. Gayatri, learned counsel for the appellant and Mr. A.Venkatesh, learned counsel for the respondents. 3.
Today, when the matter is taken up for hearing, learned counsel for the respondents informed that during the pendency of the appeal suit, the sole appellant died and the counsel appearing for the appellant sought time to take steps to bring the legal representatives on record and till date, no steps have been taken to bring the legal representatives on to record.

On this aspect, learned counsel for the appellant submits that, in spite of best efforts, no instructions have been received from the legal representatives. As such, she could not take required steps.

ln this factual position, as the sole appellant died and none came on to record to pursue the appeal, the Appeal Suit is dismissed for default, as abated. No costs.
