Petitioner challenges the order of suspension vide proceedings dated 31.10.2012. The suspension was made on the ground that petitioner was involved in Cr.No.58 of 2012 under Section 306 of Indian Penal Code, was arrested and sent to judicial remand on 25.09.2012 in connection with a lady by name Kavitha committing suicide.

No representation on behalf of the petitioner. 3.

Heard learned Government Pleader.

Learned Government pleader produced copy of para-wise remarks furnished to him and the same were taken on record. In response to Para 10 of the O.A., it is stated that the applicant was found to be innocent with reference to the incident of suicidal death of Kum/Smt Kavitha and a decision was taken to review the issue and decided to reinstate the applicant. 5.

Having regard to this statement of the respondents, the order of suspension made on 31.10.2012 is not sustainable and the same is liable to be set aside and is accordingly set aside. 6.

Accordingly, the Writ Petition (TR) is allowed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition (Tr) shall stand closed.
