HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10779 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ......... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus by declaring the inaction of the 4th respondent in selecting the Petitioner in Village Revenue Asst post under Ex-Servicemen quota basing on his qualification, as illegal, arbitrary and against the principles of natural justice and violative of Articles 14, 19 and 21 of Constitution of India and consequently to direct the Respondent Nos.2 to 4 to appoint the Petitioner in Village Revenue Asst Post under Ex-Servicemen basing on qualification of the Petitioner and take necessary action as per law ......" . Heard Mr.R.Bhaskar, learned counsel for petitioner and the learned Government Pleader for Services-II.

It has been contended by the petitioner that he is an ex-serviceman. The respondents have issued a Notification for the post of Village Revenue Assistant during the year 2013 and the petitioner has responded to the said Notification. Pursuant to his application, the petitioner was subjected to written test and interview. But, for the reasons best known to the respondents, the respondents have not filled up the post of Village Revenue Assistant by appointing qualified candidate, who appeared pursuant to the said Notification. The petitioner submits that he is qualified and eligible to be appointed as Village Revenue Assistant and the petitioner has submitted a series of representations and one such representation is dated 25.02.2018 requesting the respondents to consider his case for appointment to the post of Village Revenue Assistant under ex-servicemen quota.

The learned counsel for the petitioner has contended that the respondents have neither considered the case of the petitioner for appointment to the post of Village Revenue Assistant nor disposed of his representation submitted on 25.02.2018. Learned counsel, therefore, contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 25.02.2018 and pass appropriate orders in accordance with law.

The learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed in accordance with law on the representation submitted by the petitioner.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 25.02.2018 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
