HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

The Karimnagar District Co-operative Central Bank Limited, Karimnagar, petitioner herein, challenging the order of the authority under Section 50 of the Andhra Pradesh Shops and Establishments Act, 1988 in case No. A.P.S.E.11/2000. By order dated 02.03.2010, in the said case, the authority held that denial of full pay and allowance for the period of suspension beyond one year is erroneous and directed payment of difference of pay and allowances after adjustment of the subsistence allowance paid i.e., Rs.76,116.95 and awarded penalty of equal amount. 2.

When the matter is taken up for consideration, learned counsel for 4th respondent submitted that 4th respondent is willing to settle the dispute instead of litigating the matter further if some consolidated amount is paid to him. He has suggested that his client would settle for Rs.1,25,000/-. This offer of the 4th respondent was put to petitioner-Bank and on instructions from the petitioner-Bank, learned counsel reported consent of the Bank if the 4th respondent receives consolidated amount of Rs.1,25,000/- as full and final settlement of the dispute. 3.

Having regard to the fact that petitioner-Bank as well as 4th respondent have agreed for resolution of the dispute by way of settlement and since petitioner-Bank has agreed to pay consolidated amount of Rs.1,25,000/- (Rupees one lakh twenty five thousand only) to the 4th respondent, recording the same the writ petition is disposed of. Accordingly, petitioner-Bank is directed to

pay the amount agreed, to the 4th respondent within a period of six weeks from the date of receipt of copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
