THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4495 of 2016 ORDER:
This writ petition, filed under Article 226 of the Constitution of India, challenges the action of the 3rd respondent - the Chief Engineer, Kakatiya Thermal Power Project, Chelpur, Warangal District in not issuing the appointment order in favour of the petitioner despite the orders issued by the 1st respondent vide Memo No.CMD/ D(HR)/DGM(HR)/PO.K/95/2015-11, dated 12-01-2016. According to the petitioner, he is eligible and entitled to be considered for appointment in the respondent organization and in furtherance of the same he made an application for providing employment under land loser quota. It is further stated that pursuant to this scrutiny was made by the District Level Scrutiny Committee, Hyderabad headed by the District Collector and the respondent authorities selected him and the 1st respondent issued memo No.
CMD/D(HR)/ DGM(HR)/PO.K/95/2015-11, dated 12-012016, granting approval to provide employment also. The grievance of the petitioner in the present writ petition is that despite the said approval granted by the 1st respondent no action has been taken so far by the respondent authorities in the direction of appointing the petitioner herein.
Today, when the matter is called, on instructions, it is submitted by learned Standing Counsel for respondents'
corporation that certain clarifications are required to be obtained in the matter and the process of appointment will be finalized shortly
after securing the clarification and sought some time for the same. Having regard to the nature of controversy and in the facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if a direction is issued to the respondents herein to take appropriate action pursuant to the Memo No.CMD/D(HR)/ DGM(HR)/PO.K/95/201511, dated 12-01-2016 issued by the 1st respondent by fixing some time frame.
For the aforesaid reasons, the writ petition is dispose of, directing the respondents herein to take appropriate action pursuant to the Memo No.CMD/D(HR)/DGM(HR)/PO.K/95/ 201511, dated 12-01-2016, within a period of three (3) weeks from the date of receipt of a copy of this order, in accordance with law. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
