HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2959 of 2017 ORDER :

This criminal petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') by the petitioner/A.1 to enlarge him on bail in Crime No.4 of 2016 of Y.Ramavarm Police Station, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the Act'), as he is in judicial custody since 01.02.2016.

The petitioner filed copy of the order passed by this Court, dated 07.11.2016, in Crl.P.No.15230 of 2016 and the same was dismissed. However, subsequent dismissal of the earlier application, there were no changed circumstances in the investigation or a new ground is urged before this Court. Therefore, in the absence of any major circumstances, the petitioner is not entitled to renew his request for grant of regular bail based on the same facts in view of the law declared by the apex Court in State of Tamil Nadu v. S.A.Raja1. 3.

However, at the end of arguments, Sri A.Prabhakar Rao, learned counsel for the petitioner, requested this Court to direct the trial Court to dispose of the case within time frame treating it as Under Trial Prisoner case. Hence, the I-Additional District Judge, East Godavari at Rajamehndravam, is directed to decide the Sessions 1 (2005) 8 SCC 380

Case as expeditiously as possible, preferably not latter than three months from the date of receipt of this order. 4.
