HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7402 of 2017 ORDER:

Heard learned counsel for the petitioners/accused Nos.1 to 4 in crime No.95 of 2017 of Abdullapurmet Police Station, Rachakonda District, registered for the offences punishable under Sections 447 & 427 r/w 34 IPC and also learned Public Prosecutor representing the 1st respondent-State and perused the grounds urged in the quash petition and the contents of the FIR and the material with reference to the civil suit referred in the FIR. Though it is the contention that it is a purely civil dispute, it is premature to interfere with the investigation at the nasal stage much less to quash the proceedings, but for to say pending investigation not to arrest the petitioners/accused. However, it will not prevent the police to secure the presence of the petitioners for the purpose of investigation.

Accordingly and in the result, the Criminal Petition is disposed of with the above observations.
