WRIT PETITION No. 24834 of 2015 ORDER:
Heard learned Counsel for the petitioners and learned Government Pleader for the respondents.
The petitioners are agriculturists. It appears that on 26.6.2015 the Vigilance and Enforcement Officials of Guntur inspected the house of the petitioners and seized 193 bags of Red Gram worth about Rs.9,05,170/- on the ground that the petitioners illegally stored the said stock without possessing any valid licence. Thereafter 6-A proceedings were initiated and the same are pending before the second respondent. The petitioners appear to have filed an application before the second respondent for release of the seized stock expressing their willingness and readiness to furnish bank guarantee. When no action was taken, the present Writ Petition is filed.
Since the petitioners are ready and willing to furnish the bank guarantee for the value of the seized goods, it is just and appropriate for the respondents to release the seized goods since their interest is being protected. In the circumstances, the second respondent is directed to release the seized stock on condition of the petitioners furnishing bank guarantee for a sum of Rs.9,05,170/- within fifteen days from the date of receipt of a copy of this order. Till such time, the respondents shall not dispose of the seized stock through open auction. The Writ Petition is disposed of.
