03.07.2023 ML, J I.A.No.1 of 2023 This application has been filed to relax the condition No.ii imposed against the petitioner in bail order viz., "the petitioner/accused shall report before the Station House Officer, K.P.H.B. Colony Police Station, on every Sunday and Thursday between 10.30 a.m., and 12 p.m., till filing of the final report", vide order dated 27.04.2023 in Crl.P.No.3970 of 2023.
Learned counsel for the petitioner stated that the petitioner has been attending before the police station for nearly two months as per the directions of this Court dated 27.04.2023, however, till date no charge sheet has been filed by the police. Further, he submitted that continuously attending before the concerned police station causing trouble to the petitioner. In view of the submission made by the learned counsel for the petitioner and considering the nature of offence, presence of petitioner before the concerned police station is unwarranted.
Accordingly, this application is allowed and the condition No.ii in Crl.P.No.3970 of
2023 imposed by this Court, dated 27.04.2023 is relaxed. However, the petitioner shall appear before the Station House Officer, K.P.H.B. Colony Police Station, as and when police requires his attendance by proper summons.
