HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.8980 of 2014 ORDER:

Heard Sri Avinash Desai, learned counsel for petitioners, Sri Namavarapu R Rao, learned counsel for the 1st respondent and Sri K.R.Koteswara Rao, learned standing counsel for the Cantonment Board.

By order dated 29.04.2014, this Court, while admitting the writ petition, directed the respondent-Board to consider the application of the petitioners for grant of permission, in accordance with Section 45 of the Cantonment Act, 2006 (for short "the Act") and the Building by-laws and, thereafter, take decision within a period of two weeks.

Pursuant to the order of this Court, the respondent-Board took a decision in compliance with Section 45 of the Act and granted building permission. Thereafter, the same was approved by the 6th respondent. Such being the position, nothing survives for adjudication. Writ petition is accordingly closed, recording that earlier resolution passed by the respondent-Board stands nullified.
