The petitioner prays for the following relief: " ...Writ of Mandamus declaring the action of the 5th respondents issued Notice No. B/225/2017 dated 04-02-2017 without following due process of law i.e. without disposing the petitioner's application for grant of house site patta certificate in Sy.No.57/1, H.No.2-1836/1, Plot No.955 of Shamshiguda Village, Kukatpalli Mandal, Medchel District in terms of G.O.Ms.No.58 (Revenue Dept), dated 30-12-2014 and pending consideration W.P.No.27151of 2015 before this Hon'ble Court as being illegal, arbitrary, improper, unjust and violation of Rules and consequently to set aside the Notice No. B/225/2017 dated 04-02-2017issued by the 5th respondent and direct the 1st to 5th respondents to Grant Assignment Proceedings under G.O.Ms.No.58, dated 30-12-2014 & G.O.Ms.No.59(Payment category) dated 30.12.2014 (Assignment-I) Department, in favour of the petitioner House site in Sy.No.57/1, H.No.2-1836/1, Plot No.955, Shamshiguda village, Kukatpalli Mandal, Medchel District..."
The case of petitioner is that the petitioner is in possession and enjoyment of H.No.2-1-836/ 1 (Plot No.955) in Survey No.57/ 1 of Shamshiguda Village, Kukatpalli Mandal, Medchal District. The grievance of petitioner is that the 5th respondent, without following due process of law, has issued eviction notice dated 04.02.2017, when the application of petitioner for grant of house site is pending. The Assistant Government Pleader, on instructions, submits that the application of petitioner is pending for regularization and
the respondents do not intend to change the physical features or interfere with the petitioner's possession and enjoyment of the subject matter of writ petition.
