This petition is filed seeking for transfer of C.C.No.697 of 2016 on the file of the Judicial Magistrate of First Class at Kurnool to any other court in Hyderabad District. 2.

Heard the counsel for the petitioner and the Public prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

The counsel for the petitioner submits that there is a threat to the life of the petitioner at Kurnool and that he has filed a report before the Station House Officer, I Town Police Station, Kurnool. To that effect, a complaint is also filed before the Court of Judicial Magistrate of First Class at Kurnool. Petitioner herein stated in the said report, that from the time he got down at Kurnool, some persons started following him upto the court premises. But absolutely there is no basis for his apprehension. Petitioner is not in a position to explain as to who those persons are and how those persons are related to the respondents, in any manner.

Hence, with such baseless apprehensions, if a party comes to the court seeking for transfer of the case, the same cannot be entertained.

The Transfer Criminal Petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
