HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.10886 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not issuing Digitalized Pattadar Pass Books for the petitioners land of an extent of Ac.1.15 guntas in Sy.No.537/B situated in Kothakonda Dharmaram village Bheemadevarpalle Mandal Warangal Urban District is illegal improper arbitrary violative of Article 300A of the Constitution of India besides being opposed the Principles of Natural Justice and consequently direct the respondents to issue the Digitalized Pattadar Pass Books and Title Deeds for the petitioners land of an extent of Ac.1.15 guntas in Sy.No.

537/B situated in Kothakonda Dharmaram village Bheemadevarpalle Mandal Warangal Urban District by entering the petitioners name in the Digitalized Revenue Records of the Telangana State and pass such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

Perusal of the record reflects that the petitioner was already issued a regular pattadar pass book under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, (for brevity 'the Act of 1971'). However, to avail the benefit of the Government's Rytu Bandhu scheme, the petitioner would have to produce the new pattadar pass book which is being issued by the revenue authorities. His complaint before this Court is that despite making a representation for issuance of such a document, the Tahsildar concerned remained unmoved. The petitioner already submitted a representation in this regard on 15.2.2019 to the Tahsildar, Bheemadevarapalle Mandal, Warangal Urban District. Having received such an application, it is not open to the Tahsildar concerned to remain unmoved.

The Writ Petition is accordingly disposed of, directing the Tahsildar, Bheemadevarapalle Mandal, Warangal Urban District, to take appropriate action upon the petitioner's representation dated 15.02.2019 keeping in mind the fact that the petitioner was already issued a regular pattadar pass book which is still in operation. This exercise shall be completed

expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source. Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 6th June, 2019.
