THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.3198 of 2015 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the action of respondents 4 and 5 in awarding the work of extraction and transportation of sand from sand identified locations of Yeturu, Nedarpet, Obannapeta, Kondapuram of Kondapuram Mandal, YSR Kadapa District, to the persons other than Women Self Help Groups, under short tender notice No.4064/Sand Mining/2014-15, dated 31.10.2014, as illegal and arbitrary and for a consequential direction to the respondents to allot all the works of sand quarrying and transportation to the Women Self Help Groups operating in the respective areas. The claim of the petitioners in this writ petition is based on G.O.Ms.No.95 dated 28.08.2014. When the matter was heard on 06.03.2015, learned counsel appearing for the 3rd respondent has submitted that the aforesaid G.O. has been superseded by G.O.Ms.No.207 dated 17.12.2014. In view of the said submission, learned counsel for the petitioners sought time for taking appropriate steps. Today, at the hearing, no steps have been reported by the learned counsel for the petitioners.

When the very G.O., on which the petitioners are relying upon for claiming the relief, has been superseded, the question of directing the respondents to consider the claim of the petitioners as per the said G.O. does not arise. In view of the above, the writ petition is misconceived and the same is accordingly dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed. ____________________
