HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.9231 OF 2018 ORDER: (per V. Ramasubramanian, J) Aggrieved by an order of removal from service, the petitioner, who was an attender, filed a statutory appeal to the High Court. The appeal is not yet disposed of.

2. But, in the meantime, raising additional grounds of attack to the original order of penalty, the petitioner has come up with the above writ petition challenging the original order of penalty itself.

3. Heard Mr. MRK Chowdary, learned Senior Counsel for the petitioner. Smt.V. Umadevi, learned Standing Counsel takes notice for the respondents.

4. The main concern of the petitioner appears to be that some of the important grounds that ought to have been raised as against the original order of penalty were not raised in the memo of grounds of appeal. This grievance can be remedied by permitting the petitioner to file supplementary grounds of appeal before the High Court. Thereafter, if the appeal is directed to be disposed of within a timeframe, the alternative remedy which the petitioner has already availed, may even bear fruit.

5. Therefore, the writ petition is disposed of permitting the petitioner to file supplementary/ additional grounds of appeal before the 2nd respondent herein within a period of two (2) weeks from the date of receipt of a copy of this order. Thereafter, the appeal may be disposed of by the 2nd respondent, after considering the original grounds as well

as the additional grounds of appeal within a period of twelve (12) weeks from the date of receipt of the additional grounds of appeal.

6. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs. _____________________ V. RAMASUBRAMANIAN, J _______________________ ABHINAND KUMAR SHAVILI, J March 23, 2018 KTL
