RespondenUComplainant Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the grounds filed in support of the Criminal Petition, the High Court may be pleased to direct the Station House Officer, to release the petitioner on bail in the event of his arrest in Crime No. 223 ol 2021 of Jagtial Rural Police Station, Jagtial District,; The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of SRI MADAS BHARATH CHANDRA Advocate for the Petrtioner and ASSISTANT PUBLIC PROSECUTOR for the Respondent 1, the Court made the following. ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner'/ Accused No.1 seeking to grant anticipatory bail in the event of his arrest in connection with Crime No.223 of 2027 of Jagtial Rural Police Station, Jagtial District, which was registered for the offences punishable under Sections 498-A and 494 l.P.C. and Section 4 of the Dowry Prohibition Act.

Heard learned counsel appearing for the petitioner, learned Assistant Pubiic Prosecutor appearing for the respondent-State and perused the record.

The allegation in the complaint is that the petitioner, who is husband of the complainant, along with accused Nos.2 to 6 harassed the complainant both physically and mentally by demanding her to bring additional dowry of Rs.5,00,000i -. It is further alleged that petitioner herein also got married one P.Manasa of Raikal Village, without her consent. 4.
Learned counsel for the petitioner would submit that all the allegations in the complaint are false and created for the purpose ol this case; that in fact, the petitioner's family and the family of said P.Manasa are having acquaintance with each other since long back, even prior to the marriage of the petitioner with the complainant; that without there being any evidence' the complainant made false allegation against the petitioner that he got married the said Manasa He further submitted that the petitioner is a Government Employee and permanelrt resident of Regunta Village. \ been tested positive in Rapid Covid Antigen Test on 17 -O5.2O21 and he has to maintain self quarantine and ultimately, prayed this Court to grant bail to the petitioner.

Learned Assistant Public Prosecutor opposed to grant anticipatory bail to the petitioner.

Looking into the nature of allegations levelled against the petitioner/ Accused No.1 and having regard to the other facts and circumstances of the case, without going into the merits of the case, I am inclined to grant anticipatory bail to the pe ti tione r/ Accused No. 1.

Accordingly, the Criminal Petition is allowed and the petitioner/ accused No. 1 is granted anticipatory bail subject to the following terms and conditions:
(1) The petitioner/ accused No.1 is directed to surrender before the Station House Officer, Jagtial Rural Police Station, Jagtial District, within a period of four (04) weeks from the date of this order and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond to the tune of Rs.15,000/- (Rupees Fifteen thousand only) with two sureties each to the like sum, to the satisfaction of the said Station House Officer.
(2) Further, the petitioner/ accused No.1 shall appear before the Investigating Officer on 1"t Sunday of every month between 10:0O AM and 2:00 PM, commencing from 15th Ju1y, 2O2l , till completion of investigation and Iiling of charge sheet.
(3) The petitioner/ accused No. 1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investiqating the case.
